These School Portal Terms and Conditions ("Terms") govern access to and use of the Mandy Money educational platform available through learn.mandymoney.com.au ("Platform").
IMPORTANT NOTICE: MANDY MONEY IS AN EDUCATIONAL PLATFORM ONLY. ALL CONTENT PROVIDED THROUGH THE PLATFORM IS FOR GENERAL EDUCATIONAL AND INFORMATIONAL PURPOSES. NOTHING ON THE PLATFORM CONSTITUTES FINANCIAL ADVICE, PERSONAL FINANCIAL ADVICE, INVESTMENT ADVICE, LEGAL ADVICE, TAXATION ADVICE, ACCOUNTING ADVICE OR ANY OTHER PROFESSIONAL ADVICE. USERS SHOULD SEEK INDEPENDENT PROFESSIONAL ADVICE BEFORE MAKING ANY FINANCIAL, INVESTMENT, LEGAL OR TAX-RELATED DECISIONS.
By purchasing, accessing or using the Platform on behalf of a school, educational institution, teacher, staff member or student, you agree to be bound by these Terms.
1. Definitions
"Mandy Money" means Mandy Education Pty Ltd, its employees, contractors and authorised representatives.
"School" means the educational institution purchasing or providing access to the Platform.
"Authorised Users" means teachers, staff members, students and administrators authorised by the School to access the Platform.
"Educational Content" means all courses, lessons, activities, assessments, videos, resources, worksheets and other materials available through the Platform.
2. Educational Use Only
The Platform is provided solely for educational and learning purposes.
All Educational Content is designed to improve financial literacy and general knowledge. The Platform does not provide financial product advice, personal financial advice, investment recommendations, legal advice, taxation advice or professional services of any kind.
Schools, teachers, students and other Authorised Users acknowledge that:
• Educational Content is general in nature and is not tailored to any individual's circumstances;
• Educational Content should not be relied upon as a substitute for professional advice;
• Financial decisions should only be made after obtaining independent professional advice appropriate to the individual's circumstances;
• Mandy Money does not recommend any specific financial product, investment, strategy or course of action.
Schools and Authorised Users must not use the Platform for unlawful, commercial, offensive or inappropriate purposes.
3. School Responsibilities
The School is responsible for:
• Managing student access to the Platform;
• Ensuring student information provided to Mandy Money is accurate;
• Obtaining any parental or guardian permissions required under applicable laws or school policies;
• Supervising student use of the Platform where appropriate;
• Ensuring compliance with applicable child safety, education and privacy obligations;
• Ensuring students understand that the Platform provides education only and does not provide personal financial advice.
4. Student Accounts
Student accounts may only be created by or with the approval of a School.
Students must not share login credentials with other users.
The School remains responsible for the management of student accounts associated with its subscription.
5. Student Data Ownership
The School retains ownership and control of student educational records, learning progress information and assessment results generated through the Platform.
Mandy Money receives a limited licence to use such information solely for:
• Delivering educational services;
• Providing technical support;
• Maintaining platform functionality;
• Generating aggregated and de-identified analytics;
• Meeting legal and contractual obligations.
6. Privacy
Personal information collected through the Platform is handled in accordance with Mandy Money's Privacy Policy.
Mandy Money does not sell student information.
Student information is not used for targeted advertising, behavioural profiling or commercial marketing purposes.
7. Learning Analytics
Mandy Money may create aggregated and de-identified reports relating to educational outcomes, platform performance and user engagement.
Such reports will not identify individual students.
8. Intellectual Property
All Educational Content, course materials, branding, graphics, software, videos, assessments and resources remain the intellectual property of Mandy Money or its licensors.
Schools receive a limited, non-exclusive, non-transferable licence to use the Educational Content during an active subscription.
Schools must not:
• Reproduce Educational Content for commercial purposes;
• Resell Platform access;
• Remove copyright notices;
• Copy substantial portions of the Platform for use outside the subscription.
9. Platform Availability
Mandy Money will use reasonable efforts to maintain Platform availability.
From time to time the Platform may be unavailable due to:
• Scheduled maintenance;
• Security updates;
• Third-party service interruptions;
• Events beyond Mandy Money's reasonable control.
Mandy Money does not guarantee uninterrupted or error-free access.
10. Third-Party Providers
The Platform may utilise third-party service providers, including learning management systems, cloud hosting providers and analytics providers.
Mandy Money may change service providers where reasonably necessary to operate the Platform.
11. Child Safety
Mandy Money is committed to maintaining a safe educational environment.
Schools remain responsible for student supervision and compliance with applicable child safety obligations.
Any suspected misuse of the Platform may result in suspension or termination of access.
12. Acceptable Use
Users must not:
• Attempt to gain unauthorised access to the Platform;
• Upload malicious software or harmful content;
• Interfere with Platform security;
• Use the Platform in a manner that disrupts other users;
• Upload unlawful, offensive or inappropriate material.
13. No Financial Advice and No Reliance
The Platform provides financial literacy education only.
Mandy Money is not acting as a financial adviser, investment adviser, accountant, lawyer, tax agent or other professional adviser.
No content on the Platform should be interpreted as:
• Personal financial advice;
• Financial product advice;
• Investment recommendations;
• Legal advice;
• Taxation advice;
• Accounting advice;
• A recommendation to buy, sell or hold any financial product or asset.
Authorised Users must not rely on Educational Content as the sole basis for making financial decisions.
Any examples, case studies, calculations, projections, simulations or scenarios provided through the Platform are illustrative only and may not reflect actual outcomes.
Past performance examples do not guarantee future results.
Mandy Money accepts no responsibility for decisions made by users based on Educational Content.
14. Suspension and Termination
Mandy Money may suspend or terminate access where:
• These Terms are breached;
• Access poses a security risk;
• Required fees remain unpaid;
• Continued access would be unlawful.
15. Subscription Expiry
Upon expiry or termination of a School subscription:
• Access to Educational Content may cease;
• Student accounts may be disabled;
• Data may be retained for a reasonable period to allow retrieval by the School;
• Personal information will be managed in accordance with applicable laws and the Privacy Policy.
16. Limitation of Liability
To the maximum extent permitted by law, Mandy Money excludes all warranties not expressly stated in these Terms.
Without limiting the above, Mandy Money makes no representation or warranty that:
• Educational Content is suitable for any particular user or circumstance;
• Educational Content will achieve any specific educational, financial or personal outcome;
• Educational Content is a substitute for professional advice;
• Any financial outcome discussed or illustrated will occur.
Mandy Money is not liable for:
• Indirect or consequential loss;
• Loss of educational outcomes;
• Financial losses arising from reliance on Educational Content;
• Investment losses or missed opportunities;
• Loss arising from School administration decisions;
• Internet or third-party service interruptions;
• Unauthorised access caused by School credential management failures;
• Decisions made by students, teachers, parents or schools based on Educational Content.
Where liability cannot be excluded under Australian law, Mandy Money's liability is limited to re-supplying the affected services or the amount paid for the relevant subscription, at Mandy Money's election.
17. Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded under the Competition and Consumer Act 2010 (Cth) or any other applicable law.
18. Governing Law
These Terms are governed by the laws of Victoria, Australia.
Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Victoria.
19. Changes to These Terms
Mandy Money may update these Terms from time to time.
Updated Terms will be published on the Platform and will take effect from the date of publication.
